Contract


Prohibited activities:

- Damaging the cabin
- Moving the cabin
- Modifying or altering the cabin any manner
- Pets
- Smoking or drugs within/nearby the cabin
- Storing of items that present a fire risk (gas heaters, cooking appliances, etc)
- Use of nails
- Holes in walls, roof, floor (pin holes, nails)
- Painting walls
- Changing flooring
- Anything that leaves marks on walls, roof, flooring, exterior
- Changing locks
- Withholding rent for any reason
- Illegal activities
- Cooking & plumbing

Your responsibilities:

- Comply with all provisions of this contract
- Pay rent on time
- Respond to our communication
- Keep the cabin in clean condition
- Maintain the cabin
- Allow for inspections
- To sure the general safety of the cabin
- Provide a minimum of one month notice of intention before lease expiry
- Contact us if there are any issues.
- Provide ID upon request to help supply information for the PPSR (Personal Property Securities Register).

Rent:

- You are to pay $_____ to 'Cabin Brokers' 01-0755-0446369-03 on the dates shown on the rental schedule with the following reference ______.
- All rent is to be paid to the nominated bank account automatically.
- We reserve the right to charge interest at a rate of 10% per month on unpaid rent.
- There is no permission to withhold any amount of rent.
- Upon the renewal of a lease, we reserve the right to modify the rental rate.

Liability:

- You indemnify Cabin Brokers against all damages, losses, and/or liabilities.
- You accept full responsibility for the safety, maintenance, contractual obligations of the cabin throughout the duration of the lease.

Keys:

You are to be provided one key for the cabin. You will be charged $20 for the replacing of any key not returned.

- You have no permission to change locks under any circumstances.

Maintenance:

You must maintain and return the cabin in the same condition it was delivered to you, barring any reasonable wear and tear.

You are to take reasonable steps to protect the cabin from damage except for reasonable wear and tear.

You must pay for the cost of any damage to the cabin.

You must notify us of any defect, maintenance issue, problem with the cabin immediately.

If the cabin is returned damaged, broken, and/or in poor condition you are liable for the cost of remedy. In circumstances where the bond doesn't cover the cost, you are liable to pay the remainder to the leasor.

Inspections:

We reserve the right to conduct inspections, giving a minimum of 24 hours notice.

Notice requirements are waived in emergency circumstances.

Term of agreement:

The length of this lease is __ months, __ weekly rental periods. Coming to the conclusion of the agreement, it will be decided to either renew or terminate the lease.

Insurance:

You are reasonable for ensuring that insurance is in place otherwise you will be held responsible for costs.

Notify change of details:

You are to notify the lessor of any change in name, address, or contact details.

Deposit:

The deposit of $____ is to be sent to Cabin Brokers 01-0755-0446369-00 with reference ____.

The deposit will be refunded at the end of the lease minus any deductions.

Prohibition to sell, change, or assign agreement:

You will not: sell, trasnfer, sign, sublease, mortgage, pledge, or deal with the cabin.

Strictly this is a rental cabin assigned to subleasor for the duration of the contractual term.

You are liable for the full costs of undertaking litigation in breach of this provision.

Termination and repossesison:

We reserve the right to terminate this lease and repossess this cabin in the event of:
- Failure to make rental payments and falling into arrears. Reposession will incur within 10 business days after the first missed rental payment.
- You become insolvent or are adjudged bankrupt
- Default
- A receivor, liquidator, official assignee, or statutory of your assets is appointed
- Any events at the sole discretion of the lessor gives concerns as to the ability to fulfil their lease obligations
- Agreement to mutually terminate this contract
- Immediate repossession and termination of lessor obligations upon damage.

Return of bond under the full discretion of the lessor in these circumstances.

Arrears and debts are expected to be paid immediately.

Credit enquiries:

You authorise the lessor, using the information supplied on your application, to make enquiries to third parties as to your credit worthiness.

You authorise the lessor to collect, retain, use, and pass information onto third parties for debt collection purposes. The lessor agrees to not on-sell information and to take reasonable steps to keep the information secure.

Prohibited from Transporting Cabin

If it is found that the cabin has been transported without the prior consent of the owner, this is to be considered a severe violation of contract and will be grounds for cancellation of the lease. In the event of lease cancellation due to this clause, the lessee will be liable for the remainder of lease payments. Bond will not be refunded. There maybe a request for more compensation to account for potential damages.

If the cabin is seized and/or permanently destroyed from the lessee by a third party from the lessee's actions, the lessee will be responsible for repaying $15,340 to Cabin Brokers.

Privacy Act 1993:

We will take reasonable precautions to protect your information and use it for proper purposes. Information maybe disclosed to third parties (credit agencies, PPSR, MoJ etc) to help support your application. You have the right to access and correct your personal information.
